Abstract

The development of information technology has transformed trading activities from conventional systems to digital transactions through online marketplaces such as Shopee and Tokopedia. This study aims to analyze online buying and selling practices on these platforms from the perspective of Islamic commercial jurisprudence (fiqh muamalah). The research employs a qualitative library research method by examining various sources, including books, academic journals, articles, and Islamic legal rulings related to electronic transactions. The findings reveal that online transactions conducted through Shopee and Tokopedia are generally permissible under Islamic law because they fulfill the pillars and conditions of a valid sale, namely the existence of sellers and buyers, clear transaction objects, known prices, and mutual consent between the parties. The transaction mechanism commonly resembles the salam contract, in which payment is made in advance while the goods are delivered later. Nevertheless, there remains the possibility of gharar (uncertainty) and tadlis (fraud) when product information is unclear or misleading, or when the delivered goods do not match the description provided. Therefore, the implementation of honesty, transparency, fairness, and consumer protection principles is essential to ensure that online transactions remain in accordance with the principles of fiqh muamalah.
